Terms and Conditions
The Exhibitor, would like to lease a booth/booths at the Maine Harvest Festival, which will be held November 10 & 11, 2012 at the Bangor Auditorium, Bangor, Maine, thereby entering into a contract with the Maine Harvest Festival (City of Bangor), hereinafter called the Producer. In so doing, the Exhibitor agrees to abide by the schedules, rules and regulations enumerated in this document and agrees that the Producer is responsible for delivering the space contracted for and a good faith effort, as defined by industry standards, to attract attendees to the show and nothing more.
All space contracted must be paid in full at the time the application is approved. There is a $50.00 non-refundable deposit at the time of approval. Requests for cancellation of contract must be made in writing and be received prior to 10/01/12. No refunds will be considered after 10/01/12.
Space rental will include, appropriate materials (pipe and drape or other, at the Producer’s discretion) to designate booth space, one (1) eight foot table /table cloth, two (2) chairs, access to 120v/15amp electric service and four (4) vendor show passes.
Booth Dimensions: 10' wide by 8' deep. Booth Cost: $100.00/per standard booth, $200.00/per corner booth. Exhibitors agree to limit their activity to their assigned booth area; no "roaming" sales will be permitted. Booths will be assigned by Producer on a first-come, first-served basis.
Move In: Exhibitor may move in on Friday November 9 from Noon until 8:00pm.
Move Out: Exhibitor agrees that they will remove all their property from the facilities by midnight on Sunday, November 11, 2012, following the close of the show.
Show Hours: Saturday November 10 from 10:00am - 4:00pm, Sunday November 11 from 10:00am- 4:00pm. Booths must be staffed at all times during show hours.
Liability Insurance: Exhibitors must carry their own Liability Insurance. Exhibitor agrees to submit a Certificate of Insurance to the Producer, no later than October 15, 2012; the amount of insurance coverage shall not be less than $1,000,000.00 each (for General Liability and Property Damage). The City of Bangor and Bangor Historic Track shall be named as certificate holders and additional insured for the event. No Exhibitor will be permitted to set up on move in day without submitting evidence of the required Insurance Coverage. Exhibitor hereby expressly agrees that it will defend, indemnify and hold the Producer harmless from any and all claims made or asserted by Exhibitor, its agents, servants or employees arising out of Exhibitor activities under this contract. Exhibitor for this purpose hereby expressly waives any and all immunity it may have under Maine's Workers Compensation Act in regard to such claims made or asserted by Exhibitor, agents, servants or employees. This indemnification provided under this paragraph shall extend to and include any and all costs for attorney's fees, expert and other witness fees of the investigations and payment in full of any and all judgments rendered in favor of Exhibitor, its agents, servants or employees against the Producer in regard to claims made or asserted by such agents, servants or employees. Exhibitor agrees to release the Producer from any and all liabilities for fire, theft or any other damages, whether caused by negligence, willful or otherwise and agrees the Producer is expressly released from any and all liabilities for any and all loss, injury or damage to persons or property.
Licenses and Certificates: Exhibitor is solely responsible for obtaining any and all state and municipal licenses and certificates necessary to lawfully conduct business in the City of Bangor.
